SSSTIK CLUB respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond promptly to claims of copyright infringement that are reported to our designated Copyright Agent.

Our Commitment to Copyright Protection

SSSTIK CLUB is a tool that allows users to download publicly available content from TikTok. We do not host, store, or control any of the content that users download through our Service. All downloaded content remains the intellectual property of the original creators and TikTok.

We are committed to:

Filing a DMCA Takedown Notice

If you are a copyright owner, or authorized to act on behalf of one, and you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement, please submit a DMCA takedown notice to our designated Copyright Agent with the following information:

Required Information

  1. Physical or Electronic Signature A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of Copyrighted Work Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
  3. Identification of Infringing Material Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  4. Contact Information Your contact information, including your address, telephone number, and an email address where you can be reached.
  5. Good Faith Statement A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

How to Submit a DMCA Notice

Please Note: To be effective, your DMCA notice must be in writing and must include all of the required information listed above. Incomplete notices may not receive a response.

Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Copyright Agent.

Required Information for Counter-Notification

Your counter-notification must include:

  1. Physical or Electronic Signature Your physical or electronic signature.
  2. Identification of Removed Material Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. Statement Under Penalty of Perjury A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Contact Information Your name, address, and telephone number.
  5. Consent to Jurisdiction A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Denver, Colorado if you are outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

What Happens After You Submit a Notice

After a DMCA Takedown Notice

  1. We will review your notice for completeness and validity.
  2. If the notice is valid, we will take appropriate action, which may include removing or disabling access to the allegedly infringing material.
  3. We may forward your notice to the user who posted the content.
  4. We will document the notice for our records.

After a Counter-Notification

  1. We will review your counter-notification for completeness.
  2. We will forward your counter-notification to the original complainant.
  3. If the original complainant does not file a court action within 10-14 business days, we may restore the removed content.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, SSSTIK CLUB has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees.

Please do not make false claims. Before submitting a DMCA notice, please ensure that you are the copyright owner or authorized to act on behalf of one, and that the use of the material is not authorized or protected by fair use or other legal doctrines.

Fair Use Considerations

Before filing a DMCA notice, please consider whether the use of your copyrighted material may constitute “fair use” under copyright law. Fair use allows limited use of copyrighted material without permission for purposes such as:
